Whitestone Law Professional Corporation (“Whitestone”, “we” or “our”) provides this website (the “Site”) for general informational purposes and for use in communicating with prospective clients. By accessing or using our Site, you agree to be bound by the following Terms of Service (“Terms”). These Terms constitute a legal agreement between you (the user of the Site) and Whitestone. If you do not agree with any of these Terms, please do not use the Site.

2. No Solicitor-Client Relationship & Confidentiality
Your use of this Site, including contacting us through the Site, does not establish a solicitor-client relationship between you and Whitestone . A solicitor-client (attorney-client) relationship arises only when we have expressly agreed to represent you – typically this will involve a mutual agreement and a written retainer or engagement letter signed by both you and us. Until such an agreement is in place, we are not your legal representatives and have no obligations to you as a client (beyond basic courtesy in communications).
Because simply contacting us does not make you a client, do not send any confidential or sensitive information to us through the website or email before we have agreed to act for you . The sole remedy for dissatisfaction with the Site or its content is to stop using the Site.

For example, under Ontario law, certain statutory warranties or conditions may apply that cannot be excluded or a business cannot exclude liability for intentional wrongdoing or gross negligence. 9. Indemnification

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You will not settle any claim covered by this indemnification provision without the prior written approval of Whitestone.
10. Governing Law and Jurisdiction
This Site is controlled and operated by Whitestone from the Province of Ontario, Canada. These Terms of Service, and any disputes arising from or relating to the Terms or your use of the Site, shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles . The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
You agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the courts of the Province of Ontario. You attorn and submit to the exclusive jurisdiction of the courts of Ontario, situated in the City of Toronto (or the applicable judicial district for our head office), for the purpose of litigating any such dispute. By using the Site, you expressly waive any objection that you may have now or in the future to the jurisdiction or venue of such courts, and any claim that any such action has been brought in an inconvenient forum.
Notwithstanding the above, Whitestone retains the right to apply for injunctive or equitable relief in any jurisdiction if necessary to protect its intellectual property or confidential information.
11. Professional Regulations and Notices
Whitestone Law Professional Corporation is a law firm organized under the laws of Ontario, Canada and is governed by the Law Society of Ontario (LSO). Our lawyers are licensed to practice law in Ontario and are subject to the LSO’s Rules of Professional Conduct. This Site and its content are primarily directed to individuals and businesses in need of legal services in Ontario. We do not purport to offer legal services in jurisdictions where we are not licensed.
Any mention of legal services or practice areas on this Site is not a guarantee of outcome, but an overview of areas in which our lawyers are experienced. We adhere to all advertising and client communication rules set by the Law Society of Ontario. For example, testimonials or case results are used in accordance with those rules and are truthful statements about our services, not misleading or unverifiable claims. If any provision of these Terms is found by a court of competent jurisdiction to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of any remaining provisions . Our failure to insist on or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any provision or right .
